Privacy Policy

Last amended on November 1, 2018 and effective as of December 5, 2018.

Starbucks China Company Limited (“Starbucks China”) and its affiliates (collectively as “Starbucks,” “we,” “our” or “us”) care very much about protecting your privacy and personal information.

Under the following circumstances, we may collect, use, and store your information:

(1) When you purchase and/or use products and/or services Starbucks offers in mainland China;

(2) When you visit, browse, and/or use:

(a) Starbucks China’s official website at www.starbucks.com.cn (also accessible at www.starbucks.cn) (“Starbucks China Official Website”), and other websites Starbucks operates and manages in mainland China (collectively as “Starbucks Websites”);

(b) Starbucks mobile application we operate and manage in mainland China (“Starbucks App”);

(c) The online channels Starbucks establishes and operates (“Starbucks Online Channels”) at any third-parties’ websites, applications or social media platforms (“Third-Parties’ Platforms”), which include, without limitation, the Starbucks Tmall official flagship store at starbucks.tmall.com (the “Starbucks Tmall Store”), the Starbucks “Say It with Starbucks” Social Gifting Platform (the “Say It With Starbucks Platform”) and other online virtual stores; and

(3) When you participate in activities of Starbucks Rewards Program and/or other activities that Starbucks may carry out in mainland China.

We intend to explain to you in this Privacy Policy (the “Policy”) what personal information we may collect, how we may use, process, store, transfer, and share such information, and the methods we provide for you to access, modify, and protect such information. We also hope that this Policy could help you decide whether or not to provide us with your personal information.

If you purchase or use the products and/or services Starbucks offers in mainland China, or visit, browse and/or use Starbucks Websites, Starbucks App and/or any Starbucks Online Channels, or participate in the activities of Starbucks Rewards Program and/or other activities Starbucks may carry out in mainland China, it will be deemed that you fully understand and consent to this Policy.

What Personal Information Does Starbucks Collect?

Personal information refers to all kinds of information recorded electronically or through other ways, which, independently, or in combination with other information, can be used to identify a natural person or reflect the activities of a specific natural person.

Unless otherwise specified by Starbucks, Starbucks may collect your personal information under the following circumstances:

(1) If you intend to register a Starbucks Rewards account,

(a) when you register the account through Starbucks App or Starbucks China Official Website, we will collect from you the information including, without limitation, your username, name, password, date of birth, gender, mobile phone number, email address, postal address, language preference, etc.; or

(b) when you use an account registered on a Third-Party’s Platform and the personal information stored in that account to register a Starbucks Rewards account, on the premise that we have obtained your consent, we will receive your information from the Third-Party’s Platform, including, without limitation, your name, username, date of birth, province and city of your location, email address, mobile phone number, gender, etc. you record on the Third-Party’s platform. If part of the above information is missing, we may collect the missing information from you pursuant to paragraph (a) above.

After you successfully register a Starbucks Rewards account, we will continuously collect relevant information from you during the process when you use the Starbucks Rewards account and/or participate in the activities of Starbucks Rewards Program;

(2) If you have registered a Starbucks Rewards account and intend to bundle an account registered on the Third-Party’s Platform with your Starbucks Rewards account, on the premise that we have obtained your consent, we will receive, from the Third-Party’s Platform, your information including, without limitation, your name, the username, date of birth, province and city of your location, email address, mobile phone number, gender, etc. that you record with the Third-Party’s Platform;

(3) If you purchase and/or accept prepaid cards or coupons through the Say It With Starbucks Platform, we will collect from you the relevant information including, without limitation, what prepaid cards or coupons you have purchased and/or accepted, frequency of your purchases and/or acceptance of such prepaid cards or coupons, your consumption amounts, dates of your purchases and/or acceptance of the prepaid cards or coupons, usage information of your prepaid cards or coupons, your username, etc.;

(4) If you purchase and/or accept products and/or services through the Starbucks Tmall Store and/or other virtual stores, we will collect from you the relevant information including, without limitation, what products and/or services you have purchased or accepted, frequency of your purchases and/or acceptance of products and/or services, amounts and dates of your consumptions, your Taobao and/or Alipay account name, your or your designated recipient’s name, mailing address, contact information, etc. Before you provide Starbucks with the designated recipient’s information above, you should ensure that you have obtained the recipient’s consent;

(5) If you purchase and/or use products and/or services through Starbucks stores or other channels designated by Starbucks (excluding Starbucks Online Channels), we will collect from you the relevant information including, without limitation, what products and/or services you have purchased and/or used, frequency of your purchases and/or use, amounts and dates of your consumptions, gifts and rewards you earned, usage information of your Starbucks Rewards cards and/or your Starbucks gift cards, etc.;

(6) If you use Starbucks Websites and/or Starbucks App, we will collect from you the relevant information including, without limitation, usage information of your website and/or Starbucks App (such as the IP address through which you log onto Starbucks Websites and/or Starbucks App, your internet service provider’s information, type of browser, operating system information, website that links you to Starbucks Websites, your geographical location information, URL information, specific services, functions and language you use, date and time of your visit, etc.) and information of the devices you use to log onto and visit Starbucks Websites and Starbucks App (such as the serial number of the device, unique device identification number and mobile network information including the telephone number), etc.;

(7) If you apply to Starbucks for a tax invoice (fapiao), we will collect from you the relevant information including, without limitation, your email address, name, recipient’s name appearing on the invoice, date of purchase, and amount of payment, etc.;

(8) If you use “Starbucks Delivers” online food ordering services through Starbucks App or Third-Parties’ Platforms, we will collect from you your username, geographical location information when you use Starbucks App, and your order information including, without limitation, your or your designated recipient’s name, mobile phone number, delivery address, name, amount and date of purchase, usage information of your Starbucks gift cards, etc. Before you provide Starbucks with the designated recipient’s information above, you should ensure that you have received the recipient’s consent;

(9) If you take part in a survey or interact with us through other ways, we will collect from you about your information including, without limitation, your username, income, marital status, job and educational background, and information about those subjects that may be of interest to you; and

(10) Other information that is relevant to a particular event or activity (for example, a resume you submit in an online job application).

How Does Starbucks Process and Use Your Personal Information?

Starbucks may process and use your personal information in order to:

(1) accept and process your order and payment, and deliver products and/or services to you;

(2) process and analyze the information and your consumption behaviors on Starbucks products and services that you purchase or use, including the consumption information recorded in your Starbucks Rewards account and any other Starbucks activities for the purpose of developing personalized promotions for you;

(3) Contact you and collect your opinions regarding the Starbucks products and/or services, Starbucks Websites, Starbucks App, or any other Starbucks activities;

(4) Address, respond to or communicate with you on your inquires and questions regarding the Starbucks products and/or services, Starbucks Websites, Starbucks App, or other Starbucks activities;

(5) Analyze and process statistics regarding your visits to Starbucks Websites, Starbucks App, and/or other Starbucks Online Channels;

(6) Communicate with you regarding Starbucks job opportunities and specific positions if you have submitted to us your personal data or your resume online;

(7) Verify your identity and update our records to protect the security of your Starbucks Rewards account or for any other legitimate purposes (such as when you need to reset the password of your Starbucks Rewards account);

(8) Allow Starbucks and its suppliers to communicate with you on branding, products, activities and promotional campaigns through email or other means of communication you have provided;

(9) Issue tax invoices to you based on your request and the information you provide;

(10) When you intend to use an account that you have registered on a Third-Party’s Platform and the personal information that is stored in the account to register a Starbucks Rewards account, or on the premise that you have registered an Starbucks Rewards account, when you intend to bundle an account that has been registered on the Third-Party’ Platform with your Starbucks Rewards account, Starbucks will first use your personal information that is provided by the Third-Party’s Platform to match with your personal information in your existing Starbucks Rewards account to verify if you have been a member of Starbucks Rewards Program.

If you are not yet a member of Starbucks Rewards Program based on the verification results, Starbucks will create a Starbucks Rewards account for you, and bundle your Starbucks Rewards account with the account that you have registered on the Third-Party’s Platform; if you are already a member of Starbucks Rewards Program based on the verification results, Starbucks will request you to locate your existing Starbucks Rewards account, and you need to bundle your account with the account that you have registered on the Third-Party’s Platform by following the instructions shown on the webpage; and

(11) Combine your personal information we collect with the information we receive from third-parties (such as a third-party survey company that we may hire, etc.).

You may refuse to provide your personal information to Starbucks. However, under such circumstance, we might not be able to provide you with certain Starbucks products or services that you may request, or you may not be able to use certain functions provided by Starbucks Websites, Starbucks App and/or Starbucks Online Channels. For example, when you purchase a product and/or service through the Starbucks Tmall Store, your order will at least record your Taobao account information, the order reference number, the product or service you purchase, and the price and method of your payment. As another example, you can register a Starbucks Rewards account only if you consent to the Policy and the provisions governing the use of personal information as provided in the Starbucks Rewards Program Terms and Conditions.

If Starbucks needs to use your personal information for other purposes not provided by the Policy, Starbucks will solicit your consent before using and processing your personal information (unless otherwise provided by laws or regulations).

How Do We Use Cooke Technology, Web Beacons and Similar Technologies?

We may use cookies, web beacons, and other similar technologies to collect usage information of Starbucks Websites and/or Starbucks App.

Cookies are small data files a website may store on your hard drive. Among other things, cookies help us improve our websites and your experience. We use cookies to see which areas and features are popular and to count your visits to our websites. In addition to cookies, we will also use web beacons and other similar technologies. Web beacons are electronic images that may be used on our websites or in our emails. We use web beacons to deliver cookies, count visits, understand usage, and campaign performance, and to tell if an email has been opened and/or acted upon.

If you do not accept cookies, please set up your browser to refuse accepting cookies, or to notify the user when cookies are received. When cookies are forbidden, you might not be able to use certain functions of Starbucks Websites.

How Does Starbucks Share with or Transfer to Third-Parties or Disclose to the Public Your Personal Information?

Starbucks China and its affiliates may share your personal information and use the information in accordance with this Policy.

We may engage third-party partners (“Partners”) to provide us with certain services (such as mail and parcel delivery agencies, data storage service agencies, cyber security service agencies, etc.), or to help to promote our products and services (such as electronic mailing service agencies, those agencies which assist us in marketing and surveys, etc.). Starbucks may also carry out cooperative activities with Partners (such as Third-Parties’ Platforms, delivery services agencies of online ordering services, etc.). When Starbucks use Partners’ services or carry out cooperation with Partners, Starbucks may share with Partners your personal information that we collect. Starbucks does not and will not permit Partners to use such information for any other purpose.

In addition to the above, under the following circumstances, Starbucks also has the right to share with or disclose to third-parties all or any of your personal information which we collect:

(1) When an individual intends to use the same mobile phone number that has been registered in your Starbucks Rewards account to register a new Starbucks Rewards account, we will verify his/her identity through your username (with the middle fields hidden) and the date of last consumption recorded in your account. Under such circumstance, if you are not the individual, he/she will get to know your username (with the middle fields hidden) and the date of last consumption recorded in your account;

(2) For the purpose related to protecting the national security, national defense, public safety, public health, and critical public interest;

(3) In compliance with the applicable laws and regulations, or to assist in the investigations and judicial proceedings of relevant administrative and judicial authorities, or to meet the compulsory requirements of the relevant administrative and judicial authorities;

(4) In order to protect your and others’ lives, properties and other important legitimate rights and interest where we were unable to obtain your consent in advance;

(5) When your personal information has been disclosed through legitimate and public channels (including, without limitation, news and press channels, governmental disclosure channels, etc.);

(6) To the extent as permitted by the applicable laws and regulations, in order to protect the legitimate rights and interest of Starbucks or its Partners; or

(7) Other circumstances as provided by laws and regulations.

Without your prior consent, Starbucks will not transfer to third-parties your personal information which we collect, except under the following circumstances:

(1) In compliance with the applicable laws and regulations, or to assist in the investigations and judicial proceedings of relevant administrative and judicial authorities, or to meet the compulsory requirements of the relevant administrative and judicial authorities; and

(2) In the event Starbucks is involved in a merger, acquisition, sale of assets, or restructuring, Starbucks may transfer your personal information to those parties involved in such transactions. If such an event were to occur, Starbucks would require the receiving parties to continue to abide by the Policy.

Minor Protection

Starbucks cares much about and strives to protect the privacy of individuals under the age of 18 (“Minors”), and does not intend to collect the personal information from Minors. Unless agreed upon by their legal guardians, Minors shall not register an account (including a Starbucks Rewards account) or provide us with their personal information such as names, contact addresses, telephone numbers, etc.

What Communication Will a Member of Starbucks Rewards Program Receive?

If you are a member of Starbucks Rewards Program, in order to ensure the sound operation of Starbucks Rewards Program and protect your rights and benefits relating to your Starbucks Rewards card and Starbucks Rewards account, we will send you communications regarding your Starbucks Rewards card, Starbucks Rewards account and/or Starbucks Rewards Program (See the Starbucks Rewards Program Terms and Conditions for detailed information) (“Starbucks Rewards Communications”). If you refuse to receive these communications, and in accordance with the terms and conditions that you agreed to when registering your Starbucks Rewards account, please apply to us to deregister your Starbucks Rewards account.

If you are a member of Starbucks Rewards Program, and you confirmed that you agreed to receive other communications from Starbucks or Starbucks’ suppliers in addition to Starbucks Rewards Communications (including promotional information regarding the Starbucks products and/or services) by selecting the option of “Subscriptions to Communications” in your Starbucks Rewards account, we will then send you those communications. If you do not wish to receive such communications, please visit the relevant webpage by signing into your Starbucks Rewards account on Starbucks China official website or the Starbucks App and set your option of “Subscriptions to Communications” in order to no longer receive such communications.

How Can You Access and Modify Your Personal Information?

If you have registered a Starbucks Rewards account, you may log into your account through Starbucks China Official Website and Starbucks App to access and edit your personal information (including your username, name, password, date of birth, gender, mobile phone number, email address, postal address, language preference and other information that is related to the Starbucks Rewards account or its activities). Please note that your birthday is consistent with the information you submitted in your registration, and it cannot be edited after registration. Each member of Starbucks Rewards Program may have only one chance to modify his/her username.

Other Starbucks programs may also allow you to access and/or edit your personal information. The editable information and the method to edit that information should be subject to the terms and conditions that you have agreed to in those Starbucks programs.

How Long Will Your Personal Information Be Stored?

We will store your personal information we collect in accordance with applicable laws and regulations.

If you a member of Starbucks Rewards Program, we will store your personal information related to Starbucks Rewards Program during the existence of your Starbucks Rewards account and within a reasonable period of time afterwards. If you apply to Starbucks to cancel your Starbucks Rewards account, we will anonymize your personal information within a reasonable period of time after your account is cancelled.

Where Is My Personal Information Stored?

The personal information we collect in mainland China will be stored within mainland China.

The personal information we collect may be sent to, or be accessed from, a country or area outside of mainland China. You agree and permit us to send your personal information to, and access to your personal information from, a country or area outside of mainland China to the extent as permitted by laws and in accordance with the Policy and mandatory requirements as provided by applicable laws.

Information Security

The security of your personal information is our top priority. Starbucks will take reasonable and practicable security measures that are consistent with the industry standards to protect your personal information for the purpose of safeguarding your personal information against unauthorized edit, access, disclosure, use or deletion.

If an information security incident occurs, we will take proper and necessary measures in accordance with laws and regulations.

Amendments to the Policy

We may amend this Policy from time to time. When we do so, we will post the amended privacy policy on Starbucks Websites. We encourage you to check for any updates and/or changes to the Policy regularly.

If you have provided us with your email address, we may email you any amended privacy policy that might substantially affect the way we use or disclose your personal information. By providing your email address, you agree to receive substantial updates to the privacy policy via email.

After the amended Policy takes effect, by purchasing or using our products and/or services in mainland China, or visiting, browsing and/or using Starbucks Websites, Starbucks App and/or other Starbucks Online Channels, or participating in Starbucks Rewards Program and/or any other Starbucks activity in mainland China, it will be deemed that you fully understand and accept the amended Policy.

Affiliates

The “Affiliates” as set forth in the Policy refers to any entities that directly or indirectly controls Starbucks China, or is controlled by Starbucks China, or is under joint control with Starbucks China.

Links to Other Websites

Please note that Starbucks Websites may contain links to other websites. The Policy may not apply to such websites. We suggest you check and review the privacy policies of those websites.

WHAT PERSONAL INFORMATION DOES STARBUCKS COLLECT?

Unless otherwise specified by Starbucks, Starbucks may collect from you the following personal information:

(1) If you registered a My Starbucks Rewards account — your username, name, password, date of birth, gender, mobile phone number, e-mail address, postal address, language preference and other information that is relevant to the operation of that account or the related program;
(2) If you purchase and/or accept products and/or services through the Starbucks Tmall Store — what products and/or services you have purchased or accepted, frequency of your purchases and/or acceptance, amount and date of your consumption, your Taobao account name, etc.;
(3) If you purchase and/or accept prepaid cards or coupons through the Say It With Starbucks Platform — what prepaid cards or coupons you have purchased and/or accepted, frequency of your purchases and/or acceptance of such prepaid cards or coupons, amount of your consumption, dates of your purchases and/or acceptance of the prepaid cards or coupons, usage information of your prepaid cards or coupons, your ID, etc.;
(4) If you purchase and/or use products and/or services through Starbucks stores or other channels designated by Starbucks (if any)(excluding the Starbucks Online Channels) — what products and/or services you have purchased and/or used, frequency of your purchases and/or use, amounts and dates of your consumption, gifts and rewards you earned, usage information of your My Starbucks Rewards cards and/or your Starbucks gift cards, etc.;
(5) If you use the Starbucks Websites and/or Starbucks App — your website usage information (including your internet service provider’s information, type of browser, website that links you to the Starbucks Websites), the IP address at the time when you log onto the Starbucks Websites and/or Starbucks App, the serial number of the device, unique device identification number, mobile network information including telephone number, your geographical location information, URL information, language you use, date and time of your visit, etc., when you log onto and visit the Starbucks Websites and/or Starbucks App;
(6) If you take part in a survey or interact with us in various other ways — demographic information such as your user ID, income, marital status, job and educational background and information about those subjects that may be of interest to you; and
(7) Other information that is relevant to a particular event or activity (for example, a resume you submit in an online job application).

HOW DOES STARBUCKS PROCESS AND USE YOUR PERSONAL INFORMATION?

Starbucks may process and use your personal information in order to:

(1) Accept and process your order and payment, and deliver products and/or services to you;
(2) Process and analyze the information concerning the Starbucks products and services which you purchase or use and your behaviors, including the consumption information recorded in your My Starbucks Rewards account and any other Starbucks activity for the purpose of developing personalized promotions for you;
(3) Contact you and collect your views regarding the Starbucks products and/or services, Starbucks Websites, Starbucks App or any other Starbucks activity;
(4) Address, respond to or communicate with you on your inquires and questions regarding the Starbucks products and/or services, Starbucks Websites, Starbucks App or any other Starbucks activity;

Starbucks China and its affiliates may share your personal information and use the information in accordance with this Policy.

We may engage third-party partners (the “Partners”) to provide us with certain services (such as mail and parcel delivery agencies, data storage service agencies, cyber security service agencies, etc.), or to help to promote our products and services (such as electronic mailing service agencies, those agencies which assist us in marketing and surveys, etc.). We may also carry out cooperative activities with the Partners (such as third-party shopping websites or social media platforms, etc.). Starbucks may share with these Partners your personal information which we collect for the purpose of providing the services and/or carrying out the cooperation as agreed upon with them. Starbucks does not and will not permit the Partners to use such information for any other purpose.

In addition to the above, Starbucks has the right to share with or disclose to third-parties all or any of your personal information which we collect under the following circumstances:

(1) For the purpose of protecting the national security, national defense, public safety, public health and critical public interest;
(2) In compliance with the applicable laws and regulations, or to assist in the investigation and judicial proceedings of relevant administrative and judicial authorities, or to meet the compulsory requirements of the relevant administrative and judicial authorities;
(3) In order to protect you and others’ lives, properties and other important legitimate rights and interest where we were unable to obtain your consent in advance;
(4) When your personal information has been disclosed through legitimate and public channels (including, but not limited to, news and press channels, governmental disclosure channels, etc.);
(5) To the extent as permitted by the applicable laws and regulations, in order to protect the legitimate rights and interest of Starbucks or its Partners; or
(6) Other circumstances as permitted by laws and regulations.

Without your prior consent, Starbucks will not transfer to third-parties your personal information which we collect, except under the following circumstances:

(1) In compliance with the applicable laws and regulations, or to assist in the investigations and judicial proceedings of relevant administrative and judicial authorities, or to meet the compulsory requirements of the relevant administrative and judicial authorities; and
(2) In the event Starbucks is involved in a merger, acquisition, sale of assets, or restructuring, Starbucks may transfer your personal information to those parties involved in such transaction. If such an event were to occur, Starbucks would require the receiving parties to continue to abide by the Policy.

MINOR PROTECTION

Starbucks cares much about and strives to protect the privacy of individuals under the age of 18 (the “Minors”), and does not intend to collect the personal information from Minors. Unless agreed upon by their legal guardians, Minors shall not register an account (including a My Starbucks Rewards account) or provide us with their personal information such as names, contact addresses, telephone numbers, etc.

WHAT COMMUNICATIONS WILL A MEMBER OF THE MY STARBUCKS REWARDS PROGRAM RECEIVE?

If you are a member of the My Starbucks Rewards Program, in order to ensure the sound operation of the My Starbucks Rewards Program and protect your rights and interest relating to your My Starbucks Rewards card and My Starbucks Rewards account, we will send you communications regarding your My Starbucks Rewards card, My Starbucks Rewards account and/or My Starbucks Rewards Program (the “My Starbucks Rewards Communications”). If you refuse to receive these communications, and in accordance with the terms and conditions you agreed to when registering your My Starbucks Rewards account, please apply to us to deregister your My Starbucks Rewards account.

If you are a member of the My Starbucks Rewards Program, and you confirmed that you agreed to receive other communications from Starbucks or Starbucks’ suppliers in addition to the My Starbucks Rewards Communications (including promotional information regarding the Starbucks products and/or services) by selecting the option of “Subscriptions to Communications” in your My Starbucks Rewards account, we will then send you those communications. If you do not wish to receive such communications, please visit the relevant webpage by signing into your My Starbucks Rewards account on Starbucks China official website or the Starbucks App and set your option of “Subscriptions to Communications” in order to no longer receive such communications.

HOW CAN I ACCESS AND MODIFY MY PERSONAL INFORMATION?

If you have registered a My Starbucks Rewards account, you may log into your account to access and edit your personal information (including your username, password, name, gender, email address, postal address and phone number). Please note that your birthday is the birthday information you submitted in your registration, and it shall not be edited after registration.

Other Starbucks programs may also allow you to access and edit your personal information. The editable information and the method to edit that information should be subject to the terms and conditions that you have agreed to in those Starbucks programs.

WHERE IS MY PERSONAL INFORMATION STORED?

The personal information we collect in mainland China will be stored within mainland China.

The personal information we collect may be sent to, or be accessed from, a jurisdiction or area outside of mainland China. You agree and permit us to send your personal information to, and agree to the access to your personal information from, a jurisdiction or area outside of mainland China to the extent as permitted by laws and in accordance with the Policy.

INFORMATION SECURITY

Information security is our top priority. Starbucks will take appropriate technical measures to protect your personal information for the purpose of safeguarding your personal information against unauthorized editing, access, disclosure, processing or erasure.

AMENDMENTS TO THE POLICY

We may amend this Policy from time to time. When we do so, we will post the amended privacy policy on the Starbucks Websites. We encourage you to check for any updates and/or changes to the Policy regularly.

If you have provided us with your email address, we may email you any amended privacy policy that might substantially affect the way we use or disclose your personal information. By providing your email address, you agree to receive substantial updates to the privacy policy via email.

After the amended Policy takes effective, by purchasing our products, using our products and/or services in mainland China, or visiting, browsing and/or using the Starbucks Websites, Starbucks App and/or other Starbucks Online Channels, or participating in the My Starbucks Rewards Program and/or any other Starbucks activity in mainland China, it will be deemed that you fully understand and accept the amended Policy.

AFFILIATES

In this Policy, the “Affiliates” means any entity that directly or indirectly controls Starbucks China, or is controlled by Starbucks China, or is under joint control with Starbucks China.
